Dispute Resolution
- Our NEC through the services of its Designated Agent who will have been appointed in terms of the laws of the land strives to ensure that all disputes that arise in the industry and have not been detected at their pre-mature inspectorate stage are dealt with in a systematic manner and to finality. Several strategies can be deployed by the Designated Agent in his area of jurisdiction to ensure that all disputes that arise in the industry are dealt with.
- Traditionally the Designated Agent will try to bring together the parties in dispute and persuade them to come to an amicable win-win outcome through a process better known as conciliation (attempting to redress disputes). The Designated Agent deploys further lawful instructions usually parallel to the process of conciliation and the processes are better known as the determination way (redressing of disputes). The process provides a quicker and a binding solution to the disputes.
- However, the parties are not only limited to the above strategies though the manner of dispute handling at their first instance is usually two way and the earlier one deliberately triggers the obvious court route. Parties may always explore further processes of litigation if they deem it fit in their peculiar circumstances.
